(“Volo”, “we,” or “us”) and our website at Volosports.com (the “Site”), as well as all related websites, applications, and other services provided by us (collectively, together with the Site, our “Services”), gather information from you on the Services, how we use and disclose such information, and the steps that we take to protect such information. This Policy also tells you about the rights and choices you have with respect to your personal information, how you can assert those rights, and how you can contact us to get answers to your questions.

We may provide different or additional privacy notices in connection with certain activities, programs, and offerings (for example, if you submit a job application to us). Additionally, we may provide additional “just-in-time” notices or notices at collection that may supplement or clarify our privacy practices or provide you with additional choices regarding your personal information.

Personal Information We Collect

This Policy applies to the personal information that we obtain in various contexts. We use the term “personal information” – also called “personal data” or “personally identifiable information” in the laws of some jurisdictions – to refer to information that reasonably identifies, relates to, describes, or can be associated with you. Data that has been deidentified or that otherwise cannot reasonably be related back to a specific person is not considered personal information.

The following are the categories and types of personal information that we or our third-party partners may collect from or about you, depending on how you interact with the Services:

  • Identifiers and contact information, such as your name, email address, mailing address, and/or phone number; 
  • Commercial information, such as credit card or debit card number;
  • Audio/visual, such as photos or videos of you at our events;
  • Professional or employment-related information, such as your job title or employer;
  • Geolocation or other information that permits us to determine your location;
  • Device and online identifiers and related information, including internet protocol (IP) address, mobile ad identifiers, data collected from cookies, beacons, and pixel tags, and similar unique identifiers;
  • Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding your interaction with an internet website, application, mobile app, or advertisement; and
  • Any other personal information that you voluntarily provide us.


How We Collect Personal Information

Personal Information You Provide.   When you use the Services, we may collect information about you, including your name, gender, email address, mailing address, telephone number, date of birth, t-shirt size, geographic area, credit card information, or preferences. You may provide us with information in various ways on the Services. For example, you provide us with information when you register for an account, use the Services, respond to surveys that you choose to complete for us, enter a contest or other promotion sponsored by us, carry out transactions through the Services, or send us customer service-related requests. You also may provide personal information to us in person, over the telephone, or via regular mail.

Cookies and Automatically Collected Information. When you use the Services, we may send cookies – small text files containing a string of alphanumeric characters – to your web browser and/or device. We may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Services. Please review your web browser’s “Help” file to learn the proper way to modify your cookie settings. Please note that if you delete, or choose not to accept, cookies from the Services, you may not be able to utilize the features of the Services to their fullest potential. We may use third party vendors who use the technologies described in this section to conduct website analytics to help us track and understand how visitors use our Services, as well. For instance, we may use Google Analytics to collect and process certain analytics data. The information generated by these cookies about your use (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Site, compiling reports on activity for its staff, and providing other services relating to web page activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. You may refuse the use of cookies by selecting the appropriate settings in your browser. By using the Site and accepting cookies, you consent to the processing of data about you by Google in the manner and for the purposes set out above. We may also automatically record certain information from your device by using various types of technology, including “clear gifs," “web beacons,” cookies, pixels, tags, and/or similar tools. This automatically collected information may include your IP address or other device address or ID, web browser and/or device type, the web pages or sites that you visit just before or just after you use the Services, the pages or other content you view or otherwise interact with on the Services, and the dates and times that you visit, access, or use the Services. We also may use these technologies to collect information regarding your interaction with email messages, such as whether you opened, clicked on, or forwarded a message. This information is gathered from all users, and may be connected with other information about you.

Location Information. We may obtain general information about your physical location, such as by use of GPS and other geolocation features in your device, or by inference from other information we collect (for example, your IP address indicates the general geographic region from which you are connecting to the Internet).

Third-Party Web Beacons and Third-Party Buttons. We may display third-party content on the Services, including third-party advertising. Third-party content may use cookies, web beacons, or other mechanisms for obtaining data in connection with your viewing of the third-party content on the Services. Additionally, we may implement third party buttons (such as “like” or “share” buttons) that may function as web beacons even when you do not interact with the button. Information collected through third-party web beacons and buttons is collected directly by these third parties, not by Volo. Information collected by a third party in this manner is subject to that third party’s own data collection, use, and disclosure policies.

Clickstream Data.   As you use the Internet, a trail of electronic information is left at each website you visit. This information, which is sometimes referred to as "clickstream data," can be collected and stored by a website's server. Clickstream data can tell us the type of computer and browsing software you use and the address of the website from which you linked to the Services. We may collect and use clickstream data as a form of aggregate information to anonymously determine how much time visitors spend on each page of our Site, how visitors navigate throughout the Services, and how we may tailor our web pages to better meet the needs of visitors. This information will be used to improve our Services.

Information from Other Sources. We may obtain information about you from third parties and sources other than the Services, such as our partners and advertisers.

How We Use the Personal Information We Collect. We use information we collect on the Services in a variety of ways in providing the Services and operating our business, including the following:

  • We use the information that we collect on the Services to operate, maintain, enhance, and provide all features of the Services, to provide services and information that you request, to respond to comments and questions and otherwise to provide support to users, and to process and deliver entries and rewards in connection with promotions that may be offered from time to time on the Services.
  • We use the information that we collect on the Services to understand and analyze the usage trends and preferences of our users, to improve the Services, and to develop new products, services, features, and functionality.
  • We may use your email address or other information we collect to contact you for administrative purposes such as customer service or to send communications, including updates on promotions and events, relating to products and services offered by us and by third parties.
  • We may use cookies and automatically collected information to: (i) personalize our Services, such as remembering information about you so that you will not have to re-enter it during your visit or the next time you visit the Services; (ii) provide customized advertisements, content, and information; (iii) monitor and analyze the effectiveness of the Services and third-party marketing activities; (iv) monitor aggregate site usage metrics such as total number of users, features used, and pages viewed; and (v) track your interactions, submissions, status, or other activities on the Services.
  • We may use personal information for security and fraud prevention, to comply with legal obligations, and to support core business functions.
  • For any additional purposes that you specifically consent to.

We reserve the right to supplement your personal information with information we gather from other sources, which may include online and offline sources. We may collect information that is not personal information (“non-personal information”), including anonymous or aggregate data, or information lawfully made available from federal, state, or local government records. Because non-personal information does not personally identify you, we may collect, use, and disclose such information for any purpose permitted by law. In some instances, we may combine non-personal Information with personal information. If we combine any non-personal information with personal information, the combined information will be treated by us as personal information to the extent that it is capable of personally identifying you. We reserve the right to develop and derive aggregate data (meaning information that relates to a group or category of individuals, from which individual identities have been removed) from personal information in order to enhance and maintain the Services, and such aggregate data will be treated as non-personal information.

How We Disclose Personal Information. In addition to using your personal information ourselves for the reasons stated above (and as otherwise mentioned in this Policy), we may disclose your personal information to other affiliates and entities in the following circumstances:

Sports Leagues: If you elect to participate in sports leagues, pick-up play, drop-ins, events, or other activities organized through the Services, we will provide your name and other contact information to the organizers and other participants in such sports leagues, games, events, activities, or organizations.

Publicly Available: Any information that you voluntarily choose to include in a publicly accessible area of the Services will be available to anyone who has access to that content, including other users.

Service Providers: We may work with third party service providers to provide website and application development, hosting, maintenance, and other services for us. These third parties may have access to or process information about you as part of providing those services for us. Generally, we limit the personal information provided to these service providers to that which is reasonably necessary for them to perform their functions, and they are only permitted to do so in connection with performing services for us.

Payment Processors:   If you make a purchase through the Services, your payment card details are processed by third party payment processors, such as Stripe and Bill.com, and subject to their respective privacy policies at    https://stripe.com/privacy, and   https://www.bill.com/privacy. We only receive the date of your transaction, the amount of the transaction, and other transaction details. We do not receive your full credit or debit card number.

Corporate Affiliates: We may share personal information with our corporate affiliates and subsidiaries, who process personal information on our behalf, where necessary to provide a product or service that you have requested, or in other circumstances with your consent or as permitted or required by law.

Business and Advertising Partners:    We may share your personal information with third parties who partner with us to promote products and services, provide marketing and advertisements, conduct data analytics, or use the data for other commercial purposes. We do not control how these third parties use and share your personal information once they receive it. You will need to contact such third parties directly for information about their privacy practices or to exercise any rights you may have (including if you would like to opt-out of marketing messages).

Legal Compliance:   We may disclose information about you if required to do so by law or in the good-faith belief that such action is necessary to comply with state and federal laws, in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement or other governmental agencies.

To Defend Our Rights: We also reserve the right to disclose information about you that we believe, in good faith, is appropriate or necessary to (i) take precautions against liability, (ii) protect ourselves or others from fraudulent, abusive, or unlawful uses or activity, (iii) investigate and defend ourselves against any third-party claims or allegations, (iv) protect the security or integrity of the Services and any facilities or equipment used to make the Services available, or (v) protect our property or other legal rights (including, but not limited to, enforcement of our agreements), or the rights, property, or safety of others.

Business Transfers: Personal information about our users may be disclosed and otherwise transferred to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction, or in the event of any insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.

Non-personal information:   We may make certain aggregated, automatically-collected, or otherwise non-personal information available to third parties for various purposes, including (i) compliance with various reporting obligations; (ii) for business or marketing purposes; or (iii) to assist such parties in understanding our users’ interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality available through the Services. We publicly commit to maintain and use the information in de-identified or aggregate form, and not to attempt to re-identify the information.

All of the above categories exclude text messaging originator opt-in data and consent. Data obtained through the short code SMS program will not be shared with any third parties, excluding aggregators and providers of the text message services.


Interest-Based Advertising

Targeted Advertising / Behavioral Advertising:   We may ourselves, or with third-party vendors, use your information to deliver targeted advertising to you when you visit the Site or use the Services. Cookies, clickstream data, and other similar technologies described below may be used in this process. For example, if you are searching for information on a particular product, we or our vendor may cause an advertisement to appear on other websites you view with information on that product. This form of advertising, sometimes called “targeted advertising,” “behavioral advertising,” or “cross-context behavioral advertising,” enables us and our vendors to know about your interests in connection with the delivery of a specific ad. We believe that such advertising is helpful because it allows you to see advertisements that are relevant to your interests. If you would like to opt out of these interest-based advertisements, please follow the opt-out process described in the section titled   Your Choices   below.

Cross-Device Matching: We may use your information to help us, or our third-party vendors, determine if you have interacted with our Services across multiple devices and to match such devices. To accomplish this, we may rely on information (including demographic, geographic, and interest-based data) from third parties such as data vendors, pursuant to their own privacy policies, or we may use information we collect in conjunction with such third-party data. Based on this data, we may then display targeted advertisements across devices that we believe are associated with each other, and may further provide services to our advertisers to better enable cross-device targeting and analysis. To opt-out of or restrict our use of certain cross-device data, please see the section titled   Your Choices   below.


Your Choices

If you decline to share certain information with us, we may not be able to provide to you some of the features and functionality of the Services. You may update, correct, or delete your account information and preferences at any time by accessing your account preferences page on the Services. If you wish to access or amend any other personal information we hold about you, you may contact us at    [email protected]. Please note that while any changes you make will be reflected in active user databases within a reasonable period of time, we may retain all information you submit, subject to the   Data Retention   section below.

Opting Out of Messages: If you receive commercial email from us, you may unsubscribe at any time by following the instructions contained within the email. You may also opt out from receiving commercial email from us by sending your request to us by email at    [email protected]  or by writing to us at the address given at the end of this Policy. We may allow you to view and modify settings relating to the nature and frequency of promotional communications that you receive from us in user account functionality on the Services.

Please be aware that if you opt out of receiving commercial email from us or otherwise modify the nature or frequency of promotional communications you receive from us, it may take up to ten business days for us to process your request, and you may continue receiving promotional communications from us during that period. Additionally, even after you opt out from receiving commercial messages from us, you will continue to receive administrative messages from us regarding the Services.

Cookies and Tracking Technologies: If you would like to stop or restrict the placement of cookies or flush any cookies that may already be on your computer or device, please refer to and adjust your web browser preferences. Further information on cookies is available at    www.allaboutcookies.org. By deleting our cookies or disabling future cookies, you may not be able to access certain areas or features of our Services or some of its functionality may be affected. Note that cookie-based opt-outs must be performed on each device and browser that you wish to have opted out. For example, if you have opted out on your device browser, that opt-out will not be effective on your mobile device. Be advised that cookie-based opt-outs are not effective on some mobile services.

Volo does not process or respond to web browsers’ “do not track” signals or other similar transmissions that indicate a request to disable online tracking of users who visit our Site or who use our Services. However, if you are a resident of California, Colorado, Connecticut, Texas, Montana, or New Hampshire, or a state with a similar privacy law, we treat certain opt-out preference signals as a means of opting out of the sale or sharing of personal information, or of opting out of the processing of personal information for targeted advertising, as applicable. Please see the sections titled   U.S. State Privacy Rights   below for more information.

Interest-Based Advertising:   You may opt out of receiving targeted ads from certain data and advertising partners that participate in certain industry self-regulatory programs. The Digital Advertising Alliance (DAA) provides a website at www.aboutads.info/consumers with information about how to opt out of targeted advertising from some or all of the DAA’s participating companies. Please note that by opting out, you will continue to see generic advertising that is not tailored to your specific interests and activities. In the event that we perform cross-device matching (as described above), once you have opted out on one device (“Opted-Out Device”), we will not use any new data from the Opted-Out Device to identify you on another device for interest-based advertising purposes, and we will not use data from another device for interest-based advertising purposes on the Opted-Out Device.

Third-Party Services

The Services may contain features or links to websites and services provided by third parties. Any information you provide on third-party sites or services is provided directly to the operators of such services and is subject to those operators’ policies, if any, governing privacy and security, even if accessed through the Services. We are not responsible for the content or privacy and security practices and policies of third-party sites or services to which links or access are provided through the Services. We encourage you to learn about third parties’ privacy and security policies before providing them with information.


Children’s Privacy

Our Services are general audience services not directed to children under the age of 18, and we do not knowingly collect personal information from children under the age of 18. When we become aware that personal information (or other information that is protected under applicable law) from a child under 18 has been collected, we will use all reasonable efforts to delete such information from our databases. If you believe we might have any personal information from or about a child under 18, please contact us by using the information in the section below titled   How to Contact Us.


Data Security

We use certain physical, managerial, and technical safeguards that are designed to improve the integrity and security of information that we collect and maintain. Please be aware that no security measures are perfect or impenetrable. We cannot and do not guarantee that information about you will not be accessed, viewed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.


Data Retention

We will retain your personal information for as long as needed to provide you with the Services, and for a reasonable time thereafter as necessary to comply with our legal obligations, to resolve disputes, and to enforce our agreements. Even if we delete some or all of your information, we may continue to retain and use anonymous or aggregate data, or any other data that constitutes non-personal information. Please note that we will not be liable for disclosures of your data due to errors or unauthorized acts of third parties.


International Visitors

The Services are hosted in the United States and are intended for visitors located within the United States. If you choose to use the Services from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the United States for storage and processing. Also, we may transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Services. By providing any information, including personal information, on or to the Services, you consent to such transfer, storage, and processing.


Changes and Updates to this Policy

Please revisit this page periodically to stay aware of any changes to this Policy, which we may update from time to time. If we modify this Policy, we will make it available through the Services, and indicate the date of the latest revision. In the event that the modifications materially alter your rights or obligations hereunder, we will use reasonable efforts to notify you of the change. Information We Collect; How We Collect It; How We Use It:   General information regarding our collection, use, and disclosure of personal information is set forth in the Policy above.

In the past 12 months, we have collected categories of personal information described in the section of the Policy above titled   Personal Information We Collect   and we have collected this information from the sources described in the section titled   How We Collect Your Personal Information. Depending on your level of interaction with us, we may not have collected your personal information from all of the categories listed in this Policy above. We collect and use your personal information for the business or commercial purposes described in the section titled   How We Use the Personal Information We Collect, and retain it pursuant to the section titled   Data Retention.

We disclose the following categories of personal information for business or commercial purposes to the categories of recipients listed below:

  • Identifiers and contact information – We may disclose this information to service providers who perform business services for us; and third parties, such as advertising networks, analytics, and social media networks.

  • Geolocation information – We may disclose this information to service providers who perform business services for us; and third parties, such as advertising networks, analytics, and social media networks.
  • Device information and unique identifiers – We may disclose this information to service providers who perform business services for us; and third parties, such as advertising networks, analytics, and social media networks.
  • Internet or other electronic network activity information – We may disclose this information to service providers who perform business services for us; and third parties, such as advertising networks, analytics, and social media networks.

We do not collect any sensitive personal information from you within the scope of State Privacy Laws.


Rights to Your Information:   In addition to the rights set forth in this Policy, State Privacy Laws may, depending on your state of residence, provide you with the following rights:

  • Right to Know.   You may have the right to know whether we process your personal information and to access such personal information. You may also have the right to request that we disclose certain information to you about our collection, use, or disclosure of your personal information. Delaware and Maryland residents have the right to obtain a list of the categories of third parties to which we have disclosed personal information, and Oregon residents may obtain a list of the specific third parties to which we have disclosed personal information.
  • Right to Data Portability.   You may have the right to obtain a copy of your personal information that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another business without hindrance, where the processing is carried out by automated means.
  • Right to Delete.   You may have the right to delete personal information that you have provided or that we have obtained about you. Please note that we may deny such request if the requested deletion falls under an exception as set forth in the State Privacy Laws.
  • Right to Correct.   You may have the right to correct inaccuracies in your personal information, taking into account the nature of the personal information and the purposes for which we process it.
  • Right to Opt-Out.   You have the right to opt out of the processing of your personal information for purposes of: (i) targeted advertising; (ii) the sale of personal information; or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. As of the latest date of the Policy, we process personal information or share it with third parties for the purposes of targeted advertising, and/or disclose data for analytics purposes in a way that is considered a “sale” as the term is broadly defined by State Privacy Laws; however, we DO NOT monetize your information. We DO NOT engage in profiling decisions based on your personal information that produce legal or similarly significant effects concerning you. For residents of California, Colorado, Connecticut, Texas, Montana, or New Hampshire, we will also treat opt-out preference signals as valid opt-out requests. We do not sell or share the personal information of consumers we actually know are less than 18 years of age, unless we receive affirmative authorization (the "right to opt-in") from either the consumer who is less than 18 (but greater than 13) years of age, or the parent or guardian of a consumer less than 13 years of age. To our knowledge, we do not sell or share the personal information of minors under 18 years of age.
  •  Right to Non-discrimination. You have the right not to receive discriminatory treatment by us for the exercise of your privacy rights. Unless permitted by the State Privacy Laws, we will not: Deny you goods or services; charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties; provide you a different level or quality of goods or services; or suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.


How to Exercise Your Rights; Verifying Your Identity:   To exercise any of your privacy rights, or if you have any questions about your privacy rights, you may contact us by: calling us at (877) 611-8656; emailing us at   [email protected]; or visiting the   Your Privacy Choices  web page.

After submitting a request, we will take steps to verify your identity in order for us to properly respond and confirm that it is not a fraudulent request. In order to verify your identity, we will ask, at a minimum, that you provide your name, email address, and relationship to us, so that we can seek to match this information with the information existing in our systems. When providing us this information, you represent and affirm that all information provided is true and accurate. If we are unable to verify that the consumer submitting the request is the same individual about whom we have collected personal information, we may contact you for more information, or we may not be able to meet your request.

Only you or an agent legally authorized to act on your behalf may make a verifiable request related to your personal information. If you are making a request as the authorized agent, we will ask you to also submit reliable proof that you have been authorized in writing by the consumer to act on such consumer’s behalf. If you are making a request as the parent or legal guardian of a known child regarding the processing of that child’s personal information, we may ask you to submit reliable proof of your identity.


Response Time; Your Right to Appeal:   We will make every effort to respond to your request within 45 days from when you contacted us. If you have a complex request, State Privacy Laws allow us up to 90 days to respond. We will contact you within 45 days from when you contacted us to inform you of the need for additional time and the reason for such extension.
